However, she scored in a range that in the schools term said that she would have struggles and need a little extra help at our expense. Your child passing or failing should not ever be at your expense when she has a legitimate disability. ADHD is a disability and is covered under OHI.

Yes, as CG said, ADHD falls under OHI, and your daughter does not have to qualify as LD to receive help under OHI. If she is scoring at or above grade level on all her standardized academic testing, you may have difficulties getting her an IEP under OHI. You still should be able to get her a 504 Plan, though. I would be interested in seeing your daughter's academic testing that was done by the school two years ago. If you want to post it here or PM it to me, I will look at it.
Keep in mind, though, for a child to receive an LD classification in third grade, the child must be very low, usually functioning on a first or kinder level in one of the qualifying LD classifications under IDEA. By the time a child reaches 5th or 6th grade, the gap between performance and IQ becomes much more apparent, and low-level performing stands out more strongly. There are many reasons for this, but I won't bore you with them. Still, what's important for you to remember is that your child most likely will qualify for help, if she has a medical dx of a disability AND is struggling in school. The question is, what kind of help--an IEP or a 504.
So, I have some questions for you: Has your child passed all your annual, state-mandated tests? Has your child failed a subject in any of her previous years in school? Do you believe your child is functioning on grade level in all academic subjects? If not, do you believe that accommodations, such as extended time on tests, hard copies of notes, a quiet place to test, etc., would allow her to function on grade level or MUST the curriculum be modified and brought down to her level, while she receives specialized instruction to bring her to level?
