Are there any agencies that act as advocates in your area? In my area there are and they come packed with their own legal aid and the cost is free. Some lawyers if you win may make the school pay as an option if they have them by you. Good luck.

I was there for 7 months or so. Not sure how you've been able to continue to tolerate it. Poor thing. That kind of stress is like taking a physical beating.
I don't like the note thing with you signing. YES, schools are all about documentation. I wonder what their agenda is. Definately keep a copy of each one. I would be pretty tempted to add a note to each one, like, Sean needs such and such classroom accommodation to address this issue, or it appears that the school needs to provide such and such a service to address this problem. Heck, I'd be pretty tempted to respond to every single phone call like a recorded message "You need to put Sean in Special Education" --- that would be my solution to every complaint they sent my way. I mean at this point, their failure to address the situation is just ludicrous.
The best way to find an advocate is to call your local CHADD chapter and ask for a referral.

katiekat, Get a Special Education atty. They are free of charge. Find out if your son's rights are being violated. He is entitled to a 504, just by some of your comments under what is call OTI (Other Health Impairment) for children diagnosed with ADHD/ADD. If he is not diagnosed, get a full evaluation on him possibly by a developmental pediatrician, Check to see if your ins will cover. Make sure the DR is good. This is your son's academic life. Children can act a certain way for a variety of reasons. There are other things which can mimic ADHD. allergies? bad classroom management? family issues? etc. Make sure if you are going to have him diagnosed with ADHD, he really has it. The checklists can fit lots of kids. If he is definitely diagnosed, give eval to school. KEEP COPIES OF EVERYTHING! NOTES, COMMUNICATION LOGS, WHATEVER THEY SAY THEY ARE GOING TO DO, EMAILS, ETC. If they do not make accommodations for him after they have the eval diagnosing him, GET A LAWYER OR CHILD ADVOCATE, if you need more info I have been through this process in PA. I do not know if your state is different. Don't give up, get educated! carol

Thanks Carol. Since I posted this back in November a few things have changed for the good. For one I did find Sean a child psychiatrist and he has his first appointment on February 4th. As far as school goes his teacher this year agrees that he does need to be evaluated. At our last I&RS meeting she told them that. I have also been in contact with an advocate and right now we are waiting a bit because things seem to headed in the right direction. He is going to be evaluated by the OT within the next few weeks. That was actually their suggestion. He is diagnosed with ADHD and he definitely has it along with a few other things most likely Aspergers. I have a big old binder with EVERYTHING in it. I have been saving up for a couple years now.
